NSW Health's statement that skin penetration procedures carried out by a registered health practitioner, or by a person acting under their direction or supervision, while providing a health service are not skin penetration procedures for the Act or the Regulation. The same fact sheet says businesses carrying out skin penetration must be registered with the local council, and names who the Regulation's additional rules apply to.
